Terms of Service — Fizzy

1. Acceptance of Terms

By creating an account or using Fizzy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Le Duc Hieu, an individual operator trading as Fizzy, based in The Netherlands ("we", "us", "our"). We reserve the right to update these Terms at any time. For material changes we will notify paid subscribers by email at least 14 days before the change takes effect. Continued use after the effective date of a change constitutes acceptance of the revised Terms.

2. Description of Service

Fizzy is a personal net worth tracking tool. It allows you to manually record account balances, set financial goals, and visualise your wealth over time. Fizzy does not connect to banks or financial institutions, does not provide real-time market data, and does not execute any financial transactions on your behalf.

Not financial advice. Nothing in Fizzy constitutes financial, investment, tax, or legal advice. All data you enter is self-reported. Always consult a qualified professional before making financial decisions.

3. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at leduchieu642@proton.me if you suspect unauthorised access.

You may not share your account with others, create accounts using automated means, or register with false or misleading information.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable regulations
Attempt to gain unauthorised access to any part of the Service or its infrastructure
Reverse-engineer, decompile, or disassemble any part of the Service
Scrape, crawl, or otherwise extract data from the Service by automated means
Introduce malicious code, viruses, or disruptive data
Resell or sublicense access to the Service without written permission

5. Subscriptions and Payments

Fizzy offers a free tier and an optional paid Pro subscription. Current subscription pricing is displayed at fizzymoney.com/#pricing and in your account settings at the time of purchase. Billing is handled by Paddle (Paddle.com Market Limited), which acts as the Merchant of Record for all transactions. When you purchase a Pro subscription, you contract with Paddle for payment processing; Paddle is responsible for collecting and remitting applicable taxes (VAT, GST, etc.) in accordance with local regulations.

Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current subscription price unless you cancel before the renewal date. You will receive a reminder email from Paddle before each renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access to Pro features until then.

We reserve the right to change subscription pricing. We will notify you by email at least 30 days before any price increase takes effect for your subscription. If you do not cancel before the effective date, the new price will apply at your next renewal.

6. Refunds and Right of Withdrawal

Refunds are governed by our Refund Policy. In summary, we offer a 14-day money-back guarantee on your first payment — no questions asked.

EU and EEA consumers: Under the EU Consumer Rights Directive, you have a statutory right to withdraw from this contract within 14 days of your purchase without giving any reason. To exercise this right, contact us at leduchieu642@proton.me before the 14-day period expires. Refunds are processed by Paddle and typically appear within 5–10 business days.

7. Intellectual Property

All content, design, code, and trademarks associated with Fizzy are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.

You retain ownership of all data you enter into Fizzy. By using the Service you grant us a limited licence to store and process that data solely to provide and improve the Service.

8. Availability and Changes

We strive to maintain the Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time. We will endeavour to provide at least 30 days' notice by email of any decision to permanently discontinue the Service. If we discontinue the Service during a paid billing period for which you have already been charged, we will provide a pro-rated refund for the unused portion of that period, processed through Paddle.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €50, whichever is greater.

Nothing in this section limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable consumer protection law.

11. Termination

You may delete your account at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. Data deletion following account closure is described in our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall first be subject to good-faith negotiation. If a dispute cannot be resolved by negotiation within 30 days, it shall be submitted to the competent courts of the Netherlands, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts, in which case that right is unaffected.

Nothing in these Terms limits your statutory consumer rights under the laws of your country of residence.
